Municipal Challenge: Property Roll
As you know, property and school taxes are established in relation to the building assessment. Depending on our interpretation of the tax laws and the application of the various valuation methods, our findings may differ.
It is important for the taxpayer to be vigilant, since the value entered by the assessing agency in the first year of the roll remains immutable for the three (3) years of the assessment roll unless there is an addition or modification to the building.
The law provides for four situations giving the right to request a review:
In each of these situations, the law has set a deadline for filing an application for review.
For municipalities / cities with a roll coming into effect, the taxpayer has until April 30 (as the case may be on the tax bill or assessment notice) in the first year of filing of the roll to submit an application for review. This must be done using the prescribed form, with the information supporting the application. This application must be filed at the specified location and must be accompanied by the amount of money determined and applicable to the unit of assessment concerned. The law also provides for an application for review to be filed by registered mail.
In each of these situations, the law has set a deadline for filing an application for review.
The Municipal Evaluator must provide a response by September 1 of the filing of the roll, or the date indicated on the application for review form, attesting that the document has been received by the municipal body.
Any person who has submitted an application for review and who has not come to an agreement with the assessor may appeal to the Real Property Section of the Administrative Tribunal of Québec by filing an application with the Secretariat of the Tribunal. The application may also be made to any clerk of the Small Claims Division at a Palais de Justice. The filing deadline is 60 days from the date of dispatch of the evaluator's response. If the assessor has not filed a response, the deadline is 30 days after the deadline indicated on the return application form returned by the municipal body.
